Section I of an EHC plan

The part of an EHC plan that names the school, or type of school, your child will go to. A school named here must admit your child.

Applies in England

Section I names the school, or the type of school, your child will attend. It is left open in the draft plan Draft EHC plan The first version of an EHC plan, sent to you to check before it is made final. You get at least 15 days to comment and to ask for the school you want. Read the full definition of Draft EHC plan so you can say which school you want first.

Once a school is named in the final plan, it must admit your child. That is why the wording matters: a named school is enforceable, while a type of school on its own is looser.

If you disagree with Section I, you can appeal Appeal A formal challenge to the SEND Tribunal about a council's EHC decision. It is free to bring, and you do not need a lawyer. Read the full definition of Appeal . For an appeal about Section I alone, you do not need a mediation certificate Mediation certificate A piece of paper you get after contacting a mediation adviser. You usually need it before you can appeal about an EHC plan. Read the full definition of Mediation certificate first.
